The Talyllyn Railway Company was incorporated by Act of Parliament in 1865 with limited liability. The Principal Office is Wharf Station, Tywyn, Gwynedd, Wales LL36 9EY and the Allocation Number is 422.
Talyllyn Holdings Limited was incorporated in London in 1952 with limited liability. The Registered Office is Wharf Station, Tywyn, Gwynedd, Wales LL36 9EY and the Registration Number is 511996. It is also registered with The Charity Commission for England and Wales as Charity Number 1089053.
1. In these Conditions, the following expression has the following meaning:- “The Company” means the Talyllyn Railway Company.
2. All tickets issued by or on behalf of the Company are issued subject to:-
(a). the following Conditions of Issue, and
(b). the Company’s Bye-Laws.
3. Tickets are not transferable, and may not be used by any person other than the person to whom or for whom issued.
4. All tickets are valid for the outward and return journey only on the date shown on the ticket: any passenger travelling with a ticket the validity of which has expired will be liable to pay the full fare as if no payment had been made.
5. The holder of a ticket may break and resume his journey (in the case of a return ticket on either the outward or return journey) at intermediate stations.
6. Any passenger using a single ticket or the outward or return half of a return ticket to any station beyond that to which it is available will be liable to pay the difference between the fare actually paid for the ticket and the appropriate fare between the stations from and to which the passenger has travelled.
7. Until termination of the transit covered by the ticket, tickets remain the property of the Company and must be produced at any time during the journey or delivered upon demand by any servant or agent of the Company. Passengers failing to produce their tickets will be liable to pay the appropriate fare for the journey made.
8. Passengers must satisfy themselves that they enter the right train and that they alight at the right station, and the Company shall not in any circumstances be liable for any loss, damage, or delay arising by reason of the failure on the part of passengers to do so. In addition, in the case of passengers joining or leaving trains at stations or halts which trains are shown in the timetable to call only by request, the Company shall not be liable for any loss, damage, or delay arising from the failure of any train to stop.
9. Any ticket which has been torn or mutilated in such a manner as to deface any material information will not be valid.
10. The Company does not undertake to make any return to passengers in respect of the value of lost, mislaid, or wholly or partially unused tickets, or of any fares which may be charged in consequence of the passenger’s failure to produce his ticket when required.
11. A passenger who makes a journey or a portion of a journey in a class of carriage superior to that for which the ticket held is available will be required to pay for such journey or portion of journey, the difference between the fare for the class of carriage used, and that for which the ticket held is available.
12. The Company shall be liable under no obligation to convey passengers by rail; tickets held by passengers who are conveyed by road vehicle are subject to these Conditions which are in that case held to apply to carriage by road.
13. All fares will be accepted and tickets issued on the condition that the Company shall, if there be not sufficient accommodation in a train, or in the carriages of the class for which the ticket is issued, incur no liability for failure to carry the passenger on a particular train. In such cases arising at the commencement of a journey, passengers holding single or return tickets may have the fare paid for the unused tickets returned, provided that the whole ticket is surrendered at the point of issue immediately.
Should a number of passengers present themselves for carriage by any train in excess of the accommodation on that train, the Company shall give preference firstly to the holders of valid tickets who have onward connections by public transport, and then to the holders of valid return tickets.
If there is insufficient accommodation of the class for which a passenger holds a ticket, such passenger shall not be entitled to travel in a superior class of accommodation without paying the extra fare; such passenger may, however, travel in a superior class of accommodation without extra payment upon the express permission of the Guard. If such permission is granted, the other users of such superior accommodation shall not be entitled to any refund on account thereof.
The Company, their servants or agents shall not, in any case, be liable to any person for loss, damage or inconvenience in consequence of any passenger being conveyed in a compartment or vehicle in excess of the number it was constructed to carry.
The Company will undertake the reservation of seats or other accommodation only on the condition that if from any cause the accommodation so reserved is not available at the time of travelling to the passenger for whom the reservation was made, no liability for failure to provide the accommodation will be incurred.
14. The Company shall be at liberty to suspend or discontinue the issue of tickets, or to suspend or discontinue the running of trains, or to alter the times of starting or arrival of trains, in any circumstances in which the Company may consider it expedient so to do, and shall not in any case be liable for any loss, damage, or delay, or detention occasioned thereby. The Company shall also be at liberty to despatch trains from stations before the arrival of road or rail services booked to connect with such trains.
15. The arrangements shown in the Company’s timetables are subject to alteration without notice at any time. The Company does not guarantee that the trains will start or arrive at the times specified in the timetables, and will not be liable for any loss or damage, delay or detention which may arise from early or late running.
16. The Company shall not in any case be liable for loss of or from or delay to or detention of any articles left on the Company’s premises or in the Company’s trains or vehicles, whether or not with the permission of the Company, its servants or agents; all articles found in or upon any of the Company’s premises, trains, or vehicles, shall as between the finder and the Company, be deemed to be in the possession of the Company, and must immediately be given into the custody of the Company’s servants or agents.
The Company shall not be liable to the true owner for loss, damage, deviation, misdelivery, delay or detention, however, caused, whether or not by the neglect or default of the Company, its servants or agents, of or to such articles which may arise in connection with the custody and restoration of the same to the true owner. All articles so found which have not been claimed by the true owner within three months after being so left will be deemed to be abandoned, and may be sold or otherwise disposed of, the proceeds of any such sale being retained by the Company. Any article of a perishable nature may be disposed of earlier.
17. Passengers are required to examine their tickets and change before leaving the point of issue. The Company will not be responsible for mistakes to which attention is not called at the time of booking. The Company is under no obligation to give change.
18. Passengers are not normally allowed to travel in the guard’s van, or any other vehicle not provided for the conveyance of passengers. When special permission to do so is granted by the Company, the passenger must pay the appropriate fare, and he will be bound by the normal Conditions of Issue of Tickets.
19. The Company reserves the right to refuse admission to station platforms to any person not proceeding by train, whether or not he holds a Platform Ticket.
Platform Tickets are issued subject to the Company’s Bye-Laws, to the Conditions of Issue of Tickets nos. 2., 7., 9., 10., 14., 16. and 17. above, and to the special condition that the Company, its servants and agents, shall not be liable for, loss, damage, or delay to or detention of the holder or his property by whomsoever or howsoever caused, whether or not by the neglect of the Company, its servants or agents.
20. Privilege Tickets, Member’s Tickets, Free Tickets, and any other tickets at sub-standard fares which the Company may at any time issue are issued subject to the Company’s Conditions of Issue of Tickets, and to the special condition that holders of such tickets are granted no rights or privileges other than those enjoyed by the holders of ordinary tickets. Should any person entitled to free or reduced rate travel fail to surrender his voucher or to show his authority for such free or reduced rate travel at the time of booking, he must pay the ordinary fare for the journey being undertaken; no refund of the fare paid shall be given, even if the voucher or authority is produced after commencement of the journey.
21. The Company may from time to time impose restrictions on smoking in certain parts of its trains and premises. The Company may refuse to carry passengers ignoring notices restricting smoking.
CONDITIONS GOVERNING THE ACCEPTANCE OF LUGGAGE, MERCHANDISE, ETC.
22. The Company reserves the right to refuse to carry any luggage, merchandise, etc., either by any particular train, or at all.
23. Hand luggage, or articles (other than mentioned below) capable of being carried by the passenger himself, when accompanying the passenger may be conveyed free of charge in the passenger’s compartment, providing that no inconvenience is caused to other passengers, or in the guard’s van or luggage van.
24. A ticket must be purchased before joining the train for dogs, bicycles, tandems, motor scooters, push-chairs, prams, and articles of a similar nature. Dogs may be conveyed in the compartment with the passenger, provided that the other passengers do not object, and folded push-chairs may also be conveyed in the compartment provided that no inconvenience is caused to other passengers. In all other cases, the above articles must be conveyed in the guard’s van or luggage van.
25. The Company may carry, in addition to those items listed in Conditions 22. and 23. above, parcels, packages, etc., unaccompanied, in which case the appropriate charge must, in all cases, be paid by the consignor prior to despatch. Such unaccompanied items are conveyed only on a station-to-station basis, and are accepted only on the understanding that, if the consignee is not present to collect them from the Guard, they will be left at the destination station, whether this is manned or not: they will then be subject to Condition 16. above.
26. Exceptionally bulky, dirty, or obnoxious goods or items will be accepted for carriage, accompanied or unaccompanied, only by previous arrangement, subject also to Condition 21. above.
27. All items listed in Conditions 22. to 25. will be accepted for carriage only on the condition that the Company shall not be liable for any loss of or from, or for damage or delay to such articles and things howsoever caused, whether or not by the neglect or default of the Company, its servants or agents.
